Canal Plus Group, a division of Vivendi Universal and its subsidiaries, announced Tuesday that they have filed a lawsuit against NDS Group, a company controlled by News Corporation. Canal Plus's complaint, filed in the U.S. for the Northern District Court of California, alleges that NDS engaged in a conspiracy to harm Canal Plus's competitive position in the digital television market. In a press release, Canal Plus alleges that NDS illegally attacked Canal Plus Technologies' previously unbroken security system that had been developed to ensure that only authorised customers have access to digital television programmes. Claims state that NDS spent large amounts of money and resources to extract the code from Canal Plus's digital TV smartcards, and then provided the code to a web site frequented by counterfeiters. After the code was published on the Internet, criminal organisations flooded the market with counterfeit cards. Canal Plus estimates that NDS's actions have harmed Canal Plus in excess of *1 billion. Canal Plus's complaint alleges violations of The Racketeer Influenced and Corrupt Organizations Act, The Copyright Act, The California Unfair Competition Statute, and other violations of law. "The future of digital television depends on the industry working together to combat signal theft and to protect the integrity of distribution systems," said François Carayol, Executive Vice President of Canal Plus Group and Chairman and Chief Executive Officer of Canal Plus Technologies. "No person or company is above the law and we intend to see the law applied to halt NDS's illegal actions. We hope that NDS will immediately stop this unlawful and anti-competitive activity."

The lawsuit states that Canal Plus is developing a new smartcard, which will need to be issued to every subscriber, presumably using the modified Seca 2 encryption. Canal Plus added that the first counterfeit cards appeared in late 1999, a few months after NDS published the smartcards ROM on a site called www.dr7.com. NDS, which is 80% owned by Mr Murdoch's News Corp giant, in a statement to the Wall Street Journal, said it had not seen the lawsuit and had no comment.
